Terms of Service

The agreement governing use of Procurementor Savings Tracker

These terms ("Terms") govern access to and use of Procurementor Savings Tracker (the "Service"), provided by THE PROCUREMENTOR, a French société par actions simplifiée (SAS) with a share capital of €1,000, registered with the Metz Trade and Companies Register (RCS) under number 130 492 077, with its registered office at 10 rue du Général Devers, 57370 Phalsbourg, France ("we"). By creating an account or using the Service, you accept these Terms; the version you accepted and the date of acceptance are recorded.

1. The Service

The Service is a procurement savings-tracking tool to record initiatives, validate savings and produce reports. It is provided as software-as-a-service (SaaS).

2. Accounts and organizations

  • The first person to sign up for an organization becomes its administrator (CPO) and is responsible for managing users and roles.
  • Other members join the organization at an administrator's invitation; the administrator assigns their role and team and can deactivate their access.
  • You are responsible for the accuracy of account information and for keeping your credentials confidential.
  • You warrant that you have authority to bind your organization.

3. Free of charge, and usage limits

  • The Service is currently provided free of charge, with all of its features. No payment method is requested.
  • Fair-use limits, per organization: 25 active users, 250 initiatives, 10 MB per attached file and 1 GB of attachments. These limits can be raised on request, at no charge.
  • We may introduce a paid plan later. You will be informed with reasonable notice; no amount will be due without your express agreement, and you will be able to export your data and close your account if the plan does not suit you.

4. Acceptable use

You agree not to: (a) attempt to access another organization's data; (b) compromise the security or integrity of the Service; (c) use the Service for unlawful purposes; (d) resell the Service without authorization; (e) upload unlawful content or content infringing third-party rights.

5. Your data

You retain all rights to the data you enter. We process it only to provide the Service, in accordance with the Privacy Policy and the Data Processing Agreement (DPA). You can export your data at any time from within the application.

6. Availability

We strive to keep the Service reliable but do not guarantee uninterrupted availability. Maintenance or outages may occur. No contractual service-level agreement (SLA) is offered on the free plan.

7. Limitation of liability

The Service is provided "as is". To the extent permitted by law, our total liability under these Terms is capped at the amounts you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect losses (loss of profit, data or business). The Service is a decision-support tool: you remain responsible for your procurement and financial-reporting decisions.

8. Termination and data

  • You may stop using the Service and delete your organization at any time from the Account page.
  • Deletion immediately erases the organization's data, its attachments and its members' accounts, as described in the Privacy Policy. It cannot be undone: export your data first.
  • We may suspend or terminate an account for a serious breach of these Terms.

9. Support

Support is provided by email (contact@theprocurementor.com), in French and English, on business days. We aim to reply within two business days; no response time is contractually guaranteed on the free plan.

10. Changes to these Terms

We may update these Terms. If a change is material, the new version is shown to you at your next sign-in and must be accepted to keep using the Service.

11. Governing law

These Terms are governed by French law. Any dispute falls under the competent courts of the publisher's registered seat, subject to mandatory consumer-protection provisions.
